Terms of Service

Welcome to TruckSettle. These Terms of Service ("Terms") govern your access to and use of the TruckSettle mobile application, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who May Use the Service

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a business, you represent that you have authority to bind that business, and "you" in these Terms refers to that business.

2. The Service

TruckSettle provides tools for owner-operators and small trucking fleets to: (a) record trip logs, (b) calculate driver compensation (including miles-based, percentage-based, and per-load models), (c) track expenses and deductions, (d) generate weekly settlement PDFs, and (e) deliver those PDFs to recipients you designate, by email and (optionally, with explicit consent) by SMS/MMS.

You retain all rights to the data you enter (driver profiles, trip logs, settlement data, recipient contact details). You grant TruckSettle a limited, non-exclusive license to host, process, and transmit that data solely to provide the Service to you.

You represent and warrant that you have the right to upload any contact information you enter, and that any recipient whose phone number you add for SMS/MMS report delivery has consented to receive automated settlement reports from TruckSettle. See the SMS Opt-In Proof page for our consent flow.

6. SMS & MMS Delivery

SMS / MMS delivery is optional and is not required to use TruckSettle. The Service can be used in full with email-only or no automated delivery at all. SMS / MMS report delivery is off by default and is only activated after you (i) enable the SMS / MMS channel in Report Delivery Settings, (ii) enter a valid recipient phone number, and (iii) check the on-screen consent confirmation. You are responsible for ensuring the recipient has consented to receive automated SMS / MMS settlement reports, and you agree to only enter recipient phone numbers for which you have such permission.

Messages sent via SMS / MMS by TruckSettle are operational only — they deliver the weekly settlement-report PDF generated inside the Service. TruckSettle does not send marketing or promotional SMS / MMS messages. Message frequency varies (typically 1–4 messages per week per recipient). Message and data rates may apply. Recipients may text STOP to opt out and HELP for help at any time. The program name is TruckSettle.

7. Fees

Some features of the Service may be offered on a free or paid basis. Paid features, if any, are described in the app at the point of purchase. Carrier message and data rates for SMS/MMS are your (and your recipients') responsibility.

The Service relies on third-party providers for SMS/MMS delivery, email delivery, and cloud hosting. Their availability and performance are not guaranteed by TruckSettle.

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. TruckSettle does not provide tax, accounting, payroll, or legal advice. Settlement calculations are tools to assist you; you are responsible for verifying figures and complying with applicable laws.

10. Limitation of Liability

To the maximum extent permitted by law, TruckSettle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of or in connection with your use of the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or applicable law. Upon termination, your right to use the Service ceases; clauses that by their nature should survive will survive.

12. Changes

We may update these Terms from time to time. Material changes will be communicated within the app or by updating the "Last Updated" date above.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles, unless your local law requires otherwise.
